1. Who We Are

Grimnetic is a dark humor and creative expression platform owned and operated by Resolute Cyber Defense LLC, a Texas limited liability company. By accessing or using the platform at grimnetic.com or app.grimnetic.com, you agree to these Terms in their entirety. If you do not agree, you may not use the platform.

2. Eligibility

Grimnetic does not permit access by anyone under 13. Users aged 13 through 17 may access only age appropriate features and must have parent or guardian consent. Certain paid features, voice features, marketplace tools, and adult oriented community spaces may be limited to verified adults. Resolute Cyber Defense LLC reserves the right to terminate or restrict any account upon reasonable determination that the user does not meet the applicable eligibility threshold.

3. Acceptable Use

Grimnetic is a platform for wit, dark humor, and creative expression. The platform maintains automated content filters that intercept language targeting protected characteristics, direct threats, and content designed to intimidate, dehumanize, or harass. Users may not deploy Grimes, Capsules, personal voice recordings, or any platform feature for harassment, hate speech, targeted threats, doxxing, defamation, impersonation, or any content involving minors. Dark humor remains welcome. Targeted harm does not. Resolute Cyber Defense LLC reserves the right to remove content and terminate accounts without notice upon determination that these standards have been violated.

3b. Children's Privacy — COPPA

Resolute Cyber Defense LLC complies with the Children's Online Privacy Protection Act, 15 U.S.C. §6501 et seq. The platform does not knowingly collect personal information from children under the age of 13. Users under 13 are expressly and unconditionally prohibited from accessing any Grimnetic feature. Users aged 13 through 17 may access age-appropriate public forums only, and only with verified parental consent on file. Parents who believe their child has accessed the platform without authorization should contact us immediately at the Plano, Texas address provided in Section 11.

3c. Platform Immunity — Section 230

Resolute Cyber Defense LLC operates as an interactive computer service provider within the meaning of Section 230 of the Communications Decency Act, 47 U.S.C. §230. Accordingly, the company does not bear editorial or legal responsibility for content created and posted by third-party users, including Grimzens posting in public forums, private messages, and the Grim Exchange. This immunity does not apply to content that the company itself creates or to content that falls within the statutory exceptions set forth in 47 U.S.C. §230(e), including federal criminal law violations and sex trafficking content under the FOSTA-SESTA amendments. The company maintains active content moderation systems and reserves the right to remove content and terminate accounts at its sole discretion without prejudice to its Section 230 immunity.

4. Biometric Data and Voice Recording — Texas and Federal Compliance

The Voice Studio feature permits users to record and store their own voice as a biometric identifier for the purpose of Grime generation. Resolute Cyber Defense LLC operates in compliance with the Texas Capture or Use of Biometric Identifier Act, Tex. Bus. & Com. Code §503.001 et seq., and the California Consumer Privacy Act, Cal. Civ. Code §1798.100 et seq., where applicable. Voice recordings are stored locally on the user's device unless the user expressly saves a voice profile through the verified Grimnetic backend, in which case the audio file is stored in Cloudflare R2 and the related metadata is stored in Cloudflare D1 for the purpose of operating the selected voice feature. By accessing the voice recording feature, you expressly consent to the collection and local storage of your biometric voice identifier and confirm that: (a) the voice being recorded is your own; (b) you will not record any other person's voice without that person's express written consent; and (c) you understand that using another person's voice to generate Grimes without consent constitutes a violation of these Terms and may constitute a violation of applicable state and federal law including but not limited to the Electronic Communications Privacy Act, 18 U.S.C. §2510 et seq.

5. Intellectual Property

All Grimnetic characters, including the Thirty Six Originals known as Mort, Zepho, Nyraa, Kaelo, Vossa, Lunor, Veraa, Lioraa, Elynn, Sorenn, Noemaa, Caelis, Rexx, Tavikk, Varek, Kyrenn, Orinn, Dravenn, Nivaa, Kaiyaa, Elior, Avenn, Lyrica, Zorinn, Nexaa, Orynn, Soliss, Cerynn, Viann, Tyruss, Amarii, Aliraa, Jorenn, Brevinn, Selenn, Mirell, are creative works claimed by Resolute Cyber Defense LLC as part of the Grimnetic platform. The Grimnetic name, the Grime and Grimes terminology, the Grimzen and Grimzens terminology, the Grimzen Passport concept, and all platform design elements are proprietary. Trademark applications are pending before the United States Patent and Trademark Office. You may not reproduce, license, sublicense, or commercialize any platform character, brand element, or proprietary terminology without the express prior written consent of Resolute Cyber Defense LLC.

6. User Content

You retain ownership of content you create. By submitting content to the platform — including Grimes, Capsules, and Creator Marketplace packs — you grant Resolute Cyber Defense LLC a non-exclusive, royalty-free, worldwide license to display and distribute that content within the platform and in promotional materials referencing the platform. You represent and warrant that you own or have secured all rights necessary to grant this license with respect to any video, audio, or other media you upload.

7. Subscriptions and Payments

Paid subscriptions are billed monthly through Stripe and may be cancelled at any time. Cancellation takes effect at the end of the current billing period. One-time character pack purchases are non-refundable absent a material platform error attributable to Resolute Cyber Defense LLC. The company reserves the right to modify pricing with no less than 30 days written notice to active subscribers.

8. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Resolute Cyber Defense LLC expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The company does not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Resolute Cyber Defense LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including damages for loss of profits, goodwill, data, or other intangible losses. The company's aggregate liability to any user shall not exceed the total amounts paid by that user in the twelve months immediately preceding the claim giving rise to liability.

10. Governing Law and Dispute Resolution

These Terms are governed exclusively by the laws of the State of Texas without regard to its conflict of law provisions. Any dispute arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts of Collin County, Texas. You consent to personal jurisdiction in those courts and waive any objection to venue. Nothing in this section shall preclude Resolute Cyber Defense LLC from seeking injunctive or other equitable relief in any court of competent jurisdiction.
